Section 1. Scope of Privacy Policy

Green Martini's On-Line Privacy Policy ("Privacy Policy") applies to your use of our Web Site and to any Information you provide to us when we access the Web Site or utilize the Green Martini Services. This Privacy Policy describes how we use and collect certain Information, as defined in Section 2 below, from our Web Site and its users. Please read this Privacy Policy carefully. By visiting our Web Site, you consent to the terms of this Privacy Policy.

Section 2. Information We Collect

Green Martini takes its obligation to protect your privacy seriously. However, no internet submission is completely secure. We collect three types of information when you access our Website -- personally identifiable information, aggregate information and automatic information (collectively "Information")

Personal Information: If you choose to register with our Web Site, we will request from you certain information which could be used to identify you as an individual, including but not limited to your name, e-mail address, mailing address, occupation, work experience and telephone number ("Personal Information").

Aggregate Information. When you visit our Web Site, we also collect certain non personal information which we typically use for aggregating information. ("Aggregate Information") We gather Aggregate Information including (i) your responses to pop-up surveys requesting your experience and, personal views regarding issues of interest to our Web Site, (ii) personal preferences, and (iii) your views of our Web Site and our services. We gather that Aggregate Information through the use of cookies and web beacons, (see Section 5, below). If we associate Aggregate Information with Personal Information, we will treat that consolidated information as Personal Information.

Automatic Information. We also collect electronic information which we receive automatically when you visit our Web Site, such as your IP address, the type of computer you use and the web browsers you have used to reach our site ("Automatic Information"). If we associate Automatic Information with Personal Information, we will treat that consolidated information as Personal Information.

Section 3. Use of Information

We use the Information we collect from you in the following ways:

• to provide the information and services you request from us when using our Web Site, such as downloads and creation of accounts;
• to respond to your customer service requests and provide customer support;
• to operate our Web Site, and to perform research to improve our Web Site and services;
• to send you newsletters, company updates and marketing information requested by you;
• to send administrative e-mails (for example, if you forget your password);
• to monitor our Web Site in order to detect and prevent a security breach of our Server or Web Site; and
• For internal purposes to analyze our business.

Section 4. Green Martini's Sharing of Personal Information

We do not share or sell your Personal Information to third-parties with no affiliation to Green Martini without your express permission unless we are required to produce that information to comply with applicable laws, in response to a pending legal proceeding, to defend our company against a legal claim or to provide information to law enforcement authorities with regard to illegal activities, including but not limited to violations of the copyright laws, or potential threats to the physical safety of any person.

Section 5. Collection of Aggregate Information

Our Web Site contains electronic "cookies" and "web beacons". A "cookie" is a small text file that a Web Site sends to your computer when you visit our Web Site to record your online activity. A "web beacon" is an electronic image which we use to deliver cookies on our Web Site and to count users to our Web Site.

We use cookies and beacons to help personalize your visits, improve your experience when using our Web Site and to record your online activity. We may also include Web beacons in our e-mails and promotions to compile Aggregate Information regarding the effectiveness of our marketing campaigns. Cookies and web beacons will not damage your computer files. You may disable cookies by adjusting your browser settings. If you disable cookies, you may not have access to certain areas of our Web Site.

Section 6. Security

We take commercially reasonable steps to protect and secure your Personal Information. We have developed procedures to reduce the risk of unauthorized access to our servers to protect your Personal Information. However, we can never guarantee that data transmission through the Internet is absolutely secure and cannot eliminate all risk of misuse of your Personal Information by third-parties who intercept that transmission before it reaches our Web Site.

Section 7. Voluntary Disclosures by Green Martini authorized users

If you sign up to use the Green Martini service, it is important that you remember that the information you post is automatically made public. Therefore, we recommend that you use caution when position information on the Web Site as that Information will be available to persons who could provide it to the general public.

Section 8. Children's Privacy

We do not intend to collect Personal Information from children under the age of 13. If we obtain knowledge that we have inadvertently collected Personal Information from a child under the age of 13, we will delete that data from our systems.

Section 9. Ownership; Applicable Law.

This Privacy Policy is governed by the laws of the State of Wisconsin, without reference to its conflict of law principles.

This Web Site is designed for use in the United States. By using this Web Site, you consent to jurisdiction in Milwaukee County, Wisconsin, U.S.A. to resolve any dispute. If you access or use this Web Site from outside of the United States, you do so at your own risk and waive any claims which may arise under the laws of any other jurisdiction. If you provide us with your Personal Information or we obtain that Personal Information as a result of your use of our Web Site, you consent to the transfer and use of that Personal Information in the United States. The law of the United States may not provide the same level of privacy protection for your Personal Information as in other countries.

Section 10. Changes to Privacy Policy.

Green Martini reserves the right to change the terms of this Privacy Policy in its sole discretion. You have the responsibility to periodically review the posted Privacy Policy for any revisions.

Special Notice to California Residents

On an annual basis, California residents have the right to receive information about third parties with whom we share your Personal Information, if any, for marketing purposes during the previous calendar year, and a description of the categories of Personal Information we have shared. To make a request for this information, please send an e-mail to our Webmaster at admins@greenmartini.com. We will respond to your request within thirty days of receipt.
